Express Written Consent

Express written consent refers to the permission that customers give to a business to receive marketing messages. In the context of sweepstakes, contests, and raffles, before a Sponsor sends marketing messages related to a giveaway, they must first obtain written permission from each participant.

According to the Federal Communications Commission (FCC), as defined in the Telephone Consumer Protection Act (TCPA), express written consent can be given by someone on paper or electronically.

Express written consent can not be implied or assumed just because a customer shares a mobile phone number with a business. Texting without consent is against the law.
