A waiver is the intentional and voluntary giving up of a right by express statement or by conduct (such as by not enforcing a right).
A waiver is included in the Official Rules for a sweepstakes or contest by the Sponsor of the promotion. Via the Official Rules, a Sponsor may require Entrants to waive any right to participate in a class-action lawsuit or jury trial in order to remain eligible to win a Prize.
A Sponsor may also require a Prize Winner to sign and return a General Release & Waiver as a condition of acceptance of the Prize. A General Release & Waiver releases the Sponsor from all liability whatsoever for injuries, damages and losses to person or property sustained in connection with the sweepstakes promotion or Prize.
